THE DECISION OF THE PARLIAMENT OF THE REPUBLIC OF MOLDOVA
about the approbation of the Regulation regarding the
State Flag of the Republic of Moldova

The Supreme Soviet of the Soviet Socialist Moldavian Republic DECIDES:

  1. To approve the Regulation regarding the State Flag of the Moldavian Soviet Socialist Republic (annexed)
  2. To annul the Regulation regarding the State Flag of the Moldavian Soviet Socialist Republic, approved by the Decree of the Presidium of the Supreme Soviet of the Moldavian S.S.R. from December 24 1995 (in the redaction of the Decree of the Presidium of the Supreme Soviet of the Moldavian S.S.R. from March 5 1981)

THE REGULATION regarding the State Flag of the Moldavian Soviet Socialist Republic

  1. The State Flag of the Moldavian Soviet Socialist Republic – the Tricolour - is the official symbol of the state sovereignty of the Moldavian Soviet Socialist Republic. It symbolises the past, the present and the future of the Moldavian State, reflects its democratic principles, historical tradition of the Moldavian people, equality in rights, the solidarity and friendship between all citizens of the republic.
  2. The State Flag of Moldavian S.S.R. – the Tricolour - represents a rectangular piece of cloth, formed of three strips of equal dimensions, disposed vertically in the following sequence of the colours from the stick: blue (azure), yellow, red. In the centre, on the yellow strip is printed the State Arms of the Moldavian S.S.S.R. The proportion between the width of the Arms and the length of the Flag is 1:5, the proportion between the width and the length of the Flag is 1:2.
  3. The State Flag of the Moldavian Soviet Socialist Republic will be raised:
    1. on the buildings where take place the sessions of the Supreme Soviet of the Moldavian S.S.R. or the sessions of the local Soviets of peoples deputies of Moldavian S.S.R. - for the whole period of the sessions;
    2. on the buildings of the Supreme Soviet of the Moldavian S.S.R., of the Presidium of the Supreme Soviet of the Moldavian S.S.R., of the Councils of Ministries of the Moldavian S.S.R., local Soviets of peoples deputies of the Moldavian S.S.R., and their executive committees-permanently;
    3. on the buildings of the ministries, state committees and departments, on other state and public organs from the Moldavian S.S.R., on the building of the enterprises, institutions, organisations and on the living houses - on holidays and memorable days.

    The State Flag of the Moldavian S.S.R. can be raised also at during the ceremonies and other solemn festivities organised by the state and public organs, by enterprises, institutions and organisations.

  4. The State Flag of the Moldavian S.S.R., and its image no matter for the dimensions, have to correspond fully to the established proportions and to the representation in colour and graphic, annexed to the present Regulation.
  5. The responsibility for the strict execution of the Regulation regarding the State Flag of the Moldavian S.S.R. and of the Instruction regarding the bringing into operation of the present Regulation, belongs to the leaders of the public authorities, heads of enterprises, institutions, and organisations who have been granted the right to use the State Flag of the Moldavian S.S.R.

About the approbation of the Instruction for the bringing
into operation of the Regulation regarding the State Flag of the Republic of Moldova

The Government of the Republic of Moldova DECIDES:

  1. To approve the Instruction for the bringing into operation of the Regulation regarding the State Flag of the Republic of Moldova.
  2. To annul:
    • the decision of the Council of Ministries of the Moldavian S.S.R. from July 24 1981 no.288 “Regarding the approbation of the Instruction for the bringing into operation of the Regulation regarding the State Flag of the Moldavian S.S.R.” (M.S.S.R. news, 1981, no.8 art.68);
    • point 4 from the Modifications and Completions, approved by the decision of the Council of Ministries of the Moldavian S.S.R. from January 30 1985, no.31 (M.S.S.R. news, 1985, no.2 art.17).

THE INSTRUCTION
for bringing into operation of the Regulation regarding the State Flag of the Republic of Moldova

  1. The State Flag of the Republic of Moldova, approved according to the Regulation regarding the State Flag of the Republic of Moldova on the buildings or fixed inside buildings during official ceremonies and other festivities, has to correspond exactly to the description of the State Flag of the Republic of Moldova, rendered in the article 2 of the above mentioned Regulation, and to represent precisely the coloured images and the graphic images of the State Flag of the Republic of Moldova, annexed to this Regulation;
  2. The State Flag of the Republic of Moldova, will be raised on the specified buildings in the point “c” of the article 3 from the Regulation regarding the State Flag of the Republic of Moldova;
    1. on the following days: March 8, May 1, May 9, June 23, August 27 and August 31;
    2. on other holidays and memorable days, following the indication or the authorisation of the Government of the Republic of Moldova, of local administrative organs.
  3. The State Flag of the Republic of Moldova will be raised on the standard bearers, fixed on the roof or on the front side of the buildings or on special supports, fixed on the façades of the buildings in such a manner, that the spear of the Flag would form with the façade an angle of not more than 45 degrees, and the down part of the banner to be at least 2,5 metres height from the ground.
  4. At the raise of the State Flag of the Republic of Moldova at the same time with the state flag of another country, the State Flag of the Republic of Moldova will be fixed in the right side, the other flag-in the left side.

    If necessary to raise at the same time with the State Flag of the Republic of Moldova, state flags of other countries, these will be fixed in the left and in the right sides of the State Flag of the Republic of Moldova.

  5. The State Flag of the Republic of Moldova will be raised, but for special dispositions of the Government of the Republic of Moldova or of the local administrative organs, at 6am and will be brought down at 24am after the closing of the festivities or of the ceremonies.
  6. The State Flag of the Republic of Moldova will not be raised on damaged buildings, and in buildings under total repair, including buildings with the façade under repair, and in other cases, the decision is up to local administrative organs.
  7. During ceremonies or solemn manifestations carried by state and public organs, enterprises, organisations and institutions, the State Flag of the Republic of Moldova will be raised with the authorisation of the respective organ of local administration, of the rulers of institutions or hierarchically superior organisations.
  8. The supervision of the respecting of the provisions of the Regulation regarding the State Flag of the Republic of Moldova and of the present Instruction, will be the responsibility of local administrative organs.
  9. The responsibility for the violation of the requirements of the Instruction belongs to the rulers of local administrative organs, o9f enterprises, institutions and organisations holding the right to raise the State Flag of the Republic of Moldova.
  10. Premeditated violation of the established mode of use of the State Flag of the Republic of Moldova will be persecuted according to the Code of the Republic of Moldova regarding the administrative contravention and Penal Code of the Republic of Moldova.
